TERMS & CONDITIONS


The Axiata Game Hero Tournament (hereinafter referred as the “Tournament”) is a regional eSports tournament in collaboration with Axiata Group Berhad. The subsidiaries involved are Celcom Axiata, Boost, XL Axiata, Robi Axiata and Smart Axiata. Matchroom.net is the Event Organizer and Host of the Tournament (hereinafter referred to as “Organizer” or “Event Organizer”). 


By participating in the Tournament, the participants (“Participants”) hereby agree to be bound by these terms and conditions. The Organizer and Participants may be collectively referred to as “Parties” and individually as “Party”. 


1. GENERAL

1.1  The Organizers reserve the sole and exclusive right to amend, omit and/or vary in part or in whole these Terms and Conditions of this Tournament without prior notice to the Participants. 

1.2  All decisions regarding the interpretation of the following rules lie exclusively with the Event Organizer.  All decisions made by the Organizers on any matter relating to the 1.3 Tournament are final and binding on all Participants. 

1.3  Certain rules in this document may or may not apply to all tournaments hosted by Matchroom and are decided at the sole discretion of the Organizer.


2. TOURNAMENT MECHANISM 

2.1 PARTICIPANTS 

2.1.1 PLAYER ACCOUNT

2.1.1.1    Participants must utilize the account that they registered for the tournament. 

2.1.1.2    Participants will be locked to their registered account for the duration of the tournament and will not be allowed to switch their accounts.


2.1.2 IN-GAME NAME (IGN) 

A participant’s In-Game Name must not infringe any copyrights, or breach the

Tournament Code of Conduct. 


2.1.3 MULTI-ACCOUNT / MULTI PARTICIPATION 

Participants are not allowed to participate in the tournaments under multiple registered accounts. If a participant is found offending this rule, the participant and all his/her accounts will be disqualified from the tournament.


2.1.4 PLAYER LOGO  

Event Organizers may or may not require players to have a unique logo. Assuming a logo is required, the logo must be of sufficient quality, have no background (transparent PNG), and deemed appropriate by the Organizer.


2.1.5 SPONSORS

The Event Organizer reserves the right to prohibit, remove or disqualify players with sponsors or partners that are solely or widely known for pornographic, drug use or other adult/mature themes and products from the Tournament. 


2.2 DEVICES

Only Smartphones or Mobile Phones are allowed during the Tournament. 

Participants are prohibited from using any Tablets, Emulators, Personal Computers or Mac Systems. 


Participants are allowed to use any joysticks, phone case, matte screen protectors, or any other device peripherals so long as they do not modify the game’s controls. 


2.3 NETWORK

2.3.1  This section only applies to online tournaments in which participants will be playing at their respective locations.

2.3.2   Participants are responsible for their own internet connection. The Organizer will not be responsible for any problems that occur due to the participant's internet connection. 

2.3.3    Disconnection 

2.3.3.1    Participants are not allowed to intentionally disconnect during the tournament. 

2.3.3.2    If a participant is disconnected from the tournament due to network issues, they are allowed to reconnect while the tournament match is ongoing. 

2.3.3.3    Any request for a pause or remake due to disconnection will not be entertained. 

2.3.3.4  The Organizer may consider a pause or remake at their sole discretion under several conditions:

2.3.3.4.1   Game server failure which results in all players disconnecting and the inability to reconnect.

2.3.3.4.2  Majority of the players disconnect from the game. The number of disconnected players which constitutes a ‘majority’ is within the sole discretion of the Organisers and administrators. 

In the event where the above scenarios occur, participants are required to submit a screenshot as proof of disconnection. For the purposes of 3.3.3.4, examples of acceptable screenshots are set out below.

2.4 USAGE OF PARTICIPANT’S IMAGE OR MEDIA (Only if applicable)

2.4.2    By joining any tournament organized by Matchroom, all participants agree to license and grant to the Event Organizer, its affiliates and sub-licensees an exclusive, royalty-free, perpetual, worldwide, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish and display any images, videos, creative content that Participants may submit. This extends to their names, scores, statistics of participation on the Game etc., in whole or in part, for any purpose including but not limited to future promotion, marketing, advertising or publicity purposes in any media, without compensation, restriction on use, attribution or liability.


3. DISBURSEMENT OF PRIZE(S) 

3.1   By entering the Tournament, Participants hereby warrant that all information submitted is true, current and complete. The Organizers reserve the right to verify the eligibility of all Participants;

3.2   Prizes are non-transferable and the Organizer reserves the right to substitute prizes of equal or greater value at any time;

3.3   Participants may be required to provide proof of identity, date of birth, residential address, personal information relating to your bank account such as account holder name, account number, bank address and all other information required by the Organizer in order to successfully transfer the prize to Participants. 

3.4   Participants entitled to receive prizes will receive them within 120 days from the date of confirmation that you are the winner. 

3.5   The Organizers reserve the right to verify and query the information provided by Participants before performing the transaction/transfer.

3.6   The Organizers reserve the right to decide which currency will be used when disbursing the cash prizes (if any). It is within the sole discretion of the Organizer to allow Participants to select their preferred currency. 

3.7   Participants will be responsible to bear the fees, costs, commissions or any sort of transaction fees that might be applied by the respective institution involved in the transfer transaction.

3.8   Participants hereby agree that they are solely responsible for all taxes, fees and charges relating to the transaction/transfer of the prize. The Organizer reserves the right to deduct or withhold any applicable taxes payable by Participants from the prizes (including but not limited to withholding taxes) as required by the applicable tax laws. The Organizers do not provide tax advice and any statement in this Terms and Conditions should not be construed as tax advice. 

3.9   The Organisers may hold or refrain from transferring any prize to a Participant if for any reason the Participants’s data matches entries on blacklists, anti-money laundry lists, anti-terror list or any other compliance related list. A second compliance verification may be performed by banks, or other institutions that are involved in the prize transfer transaction.

3.10 We are not liable for any damage, loss, injury or disappointment suffered by any Participant as a result of accepting any prize;

3.11 The results, winners and any prizes in connection therewith offered will be determined by the Organizers, and such determinations are final and binding. By registering and/or participating in the Tournament, Participants agree to be bound by these determinations;

3.12 Should Participants mistakenly receive prizes that do not belong to them, whether due to a technical or human error or error in the published leaderboards or gaming software, or otherwise, the amount will remain property of the Organizers and the Organizers reserve the right to request Participants to transfer the amount back to the Organizers. If prior to the Organizers becoming aware of the error and Participants have withdrawn the funds that do not belong to them, without prejudice to other remedies and actions that may be available at law, the mistakenly paid amount will constitute a debt owed by Participants to the Organizers. In the event of an incorrect crediting, Participants are obliged to notify the Organizers immediately by email [email protected];

3.13 Participants warrant that based on the laws of their respective country of residence and otherwise, they are permitted to receive the possible prizes, including in particular cash prizes (if any), and in the event of a breach of this warranty, the Organizers have the right to refuse to award any prizes.

3.14 Participants acknowledge that certain countries/jurisdictions have laws regarding Tournaments that may prevent the Organizer from awarding you with the prize. If you are entitled to a prize but your country/jurisdiction prevents you from receiving such prize, the Organizers are not responsible to compensate you in any manner. Participants hereby acknowledge the risks associated with receiving any prize.  


4. PARTICIPANT’S WARRANTS & REPRESENTATIONS 

4.1 They have fully read and understood all the Terms and Conditions and shall be unconditionally and irrevocably bound by them, at all times without any exception;

4.2 They satisfy the eligibility requirements;

4.3 They are legally entitled to participate;

4.4 They unconditionally accept the winner(s) so selected;

4.5 They shall honor all decision of the Event Organizers with respect to the Tournament and its interpretation and to not challenge them;

4.6 To comply with all federal, state, provincial and local laws and regulations that apply. 


5. INTELLECTUAL PROPERTY RIGHTS 

All information provided in relation to the Tournament which includes but is not limited to texts, graphics, photos, sounds, videos, softwares, interactive features, trademarks and logo shall be solely owned by the Organizers. The participants undertake not to misuse any of the information contained herein, on the Website and at the Tournament. 


6. INDEMNIFICATION 

The Participant agrees to indemnify Matchroom, each of the Matchroom Entities and each of their affiliates and agents from any and all lawsuits, claims, demands, damages, liabilities and costs and expenses (including reasonable attorneys’ fees) arising out of your participation in the Tournament, or your breach or alleged breach of the covenants, representations or warranties of the Tournament Rules.


7. DISCLAIMER OF WARRANTIES 

The Event Organizer disclaims, to the maximum extent permitted by law, all conditions, warranties, representations, expressed or implied. The Event Organizer does not promise that the Tournament will be error-free or uninterrupted, or that any defects will be corrected. The Event Organizer disclaims any and all liability from the acts, omissions and conduct of any third parties in connection with or related to your participation in the Tournament. You assume total responsibility for your participation in the Tournament.


8. EXCLUSION OF LIABILITY 

8.1 To the maximum extent permitted by law, the Organizer excludes all liability in connection with the Tournament. All Participants agree to release the Organizer from and indemnify the Organizer against all liability (including negligence) for any personal injury or for any loss or damage (including loss of opportunity), whether direct or indirect, special or consequential arising out of participation in the Tournament. 

8.2 All content provided in relation to the Tournament is strictly on an “as is” basis. The Organizer does not guarantee nor warrant true and flawless representation of the game. 

8.3 The Organizer disclaims any and all responsibility and liability in relation to 

8.3.1 any errors, omissions or inaccuracies of content or submissions;

8.3.2 any personal injury or property damage of any nature resulting from the participant’s access, exposure or participation in the Tournament;

8.3.3 any loss, injury, death or any other liability arising out of the Tournament or due to participation by any person in the Tournament;

8.3.4 any loss or damage due to the Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss;

8.3.5 any unauthorized access to our secure servers and/or any and all personal information and/or financial information that may be contained therein;

8.3.6 any deletion of data or interruption or discontinuance of transmission to or from or through the Tournament;

8.3.7 the participants’ inability to access or play the Game at its optimum functionality; and 

8.3.8 any expenses and costs incurred by a Participant, including out-of-pocket expenses related to or as a consequence of participating in the Tournament.


9. NON-COMPLIANCE 

If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Organizers and which prevents the Organizers from complying with these Terms and Conditions, the Organizers will not be liable for any failure to perform or delay in performing its obligation.


10. GOVERNING LAW 

All disputes arising out of or in connection with the participants’ participation in the Tournament are governed by the laws of Malaysia without giving effect to any choice of legal rule that would cause application of laws of any jurisdiction other than Malaysia. The Participants agree that the Courts of Malaysia shall have exclusive jurisdiction over all matters arising from the Tournament. 


11. FORCE MAJEURE 

Neither Party shall be responsible for any delay or failure in performance of any part of these Terms and Conditions if and to the extent that it is caused by acts of God or nature (including wild animals), war or war-like conditions, mob violence, acts or failures to act of any governmental authority, or any other events or circumstances beyond the reasonable control of the concerned Party (“Force Majeure Event”). However no force majeure events or circumstances will excuse the Participant’s obligation to make any payments that are owed to the Organizer for Services delivered before the Force Majeure Event or that accrue due to Participant’s continued use of the Services thereafter. Neither Party will incur any liability or penalties other than the obligations to pay any outstanding Charges in the event a Service is terminated due to the Force Majeure Event.


12. SEVERABILITY 

If for any reason a court of competent jurisdiction finds any provision of these terms and conditions, or portion thereof, to be unenforceable, that provision of the terms and conditions will be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of these terms and conditions will continue in full force and effect.


13. NO WAIVER 

The waiver by either Party of any breach of these Terms and Conditions by the other Party in a particular instance will not operate as a waiver of any subsequent breaches of the same or different kind. The failure of either Party to exercise any rights under this Agreement in a particular instance will not operate as a waiver of the Party's right to exercise the same or different rights in any subsequent instance.
